Acceptance of Terms

By accessing or using Nook (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these Terms from time to time, and your continued use constitutes acceptance.

Description of Service

Nook is a family safety check-in application that enables daily well-being confirmations between family members through push notifications and SMS. The Service includes an escalation alert system that notifies designated contacts when a check-in is missed.

Eligibility

You must be at least 18 years old to create an account and use Nook. By using the Service, you represent that you meet this requirement.

Account Responsibilities

  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate contact information, including a valid email address and, if using SMS features, a valid phone number.
  • You must promptly update your information if it changes.

Acceptable Use

You agree not to:

  • Use Nook for any unlawful purpose or in violation of any applicable laws.
  • Add individuals to your care circle without their knowledge and consent.
  • Use the Service to harass, stalk, or monitor someone without their permission.
  • Attempt to circumvent rate limits, security measures, or access controls.
  • Interfere with or disrupt the Service or its infrastructure.
  • Reverse engineer, decompile, or disassemble any part of the Service.

SMS Terms

By providing a phone number and enabling SMS check-ins, you consent to receive recurring automated text messages from Nook at the number provided. Message frequency varies based on your check-in schedule and escalation events.

  • Message and data rates may apply.
  • You can opt out at any time by replying STOP to any message.
  • For help, reply HELP or contact hello@nook.bond.
  • Supported carriers include major US carriers. Carrier participation may vary.

By using SMS features, you confirm compliance with the Telephone Consumer Protection Act (TCPA) and consent to receive messages at the phone number provided.

Important Disclaimers

  • Nook is NOT a medical alert system. It does not detect falls, monitor vital signs, or provide medical response.
  • Nook is NOT a substitute for emergency services. In an emergency, always call 911 or your local emergency number.
  • Nook is NOT a replacement for regular communication with your family members. It is a supplement, not a substitute.
  • A missed check-in does NOT necessarily indicate an emergency. There are many reasons someone might miss a check-in.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOOK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Nook does not guarantee uninterrupted or error-free operation. Notifications and SMS messages may be delayed or fail due to carrier issues, network outages, or device settings. You should not rely solely on Nook for the safety of any individual.

Intellectual Property

The Service, including its design, code, content, and branding, is owned by Nook and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

Termination

You may delete your account at any time through the app settings. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in San Francisco County, California.
